ArthroCare Receives Expected Additional NASDAQ Staff Determination Letter Regarding Delayed Filing of Form 10-Q; NASDAQ Panel Decision Remains Pending

(NASDAQ: ARTC) announced today that, as expected, it received an additional NASDAQ Staff Determination Letter on November 12, 2008 in connection with the Company's inability to timely file its Quarterly Report on Form 10-Q for the period ended September 30, 2008 with the Securities and Exchange Commission (the "SEC"). The Additional Staff Determination letter states that the Company is therefore not in compliance with NASDAQ Marketplace Rule 4310(c)(14), and that this issue may serve as an additional basis for the NASDAQ Listing Qualifications Panel (the "Panel") to delist its common stock from NASDAQ.

As previously disclosed on August 19, 2008, the Company received a similar NASDAQ Staff Determination letter on August 13, 2008 in connection with the Company's inability to timely file its Quarterly Report on Form 10-Q for the period ended June 30, 2008 with the SEC. The Company appealed that Staff Determination and attended a hearing before the Panel this fall during which the Company requested that the Panel grant additional time to regain compliance with NASDAQ's filing requirement. Pending a decision by the Panel, the Company's common stock will remain listed on The NASDAQ Global Select Market. There can be no assurance that the Panel will grant the Company's request for continued listing.
