NEC withdraws complaint against Qualcomm lodged with European body

TOKYO, Nov. 24, 2009 (Kyodo News International) -- Japanese electronics maker NEC Corp. said Tuesday that it has withdrawn a complaint lodged with the European Commission in connection with alleged violations of the European Union's antitrust law by Qualcomm (NASDAQ:QCOM) Inc. of the United States.

NEC said it filed a complaint with the commission in October 2005, alleging that the U.S. communications technology company had failed to license essential patents on fair terms, but decided not to proceed with the complaint after the Japan Fair Trade Commission ordered Qualcomm in September to stop abusing its technological dominance over Japanese mobile phone manufacturers.

According to the FTC, Qualcomm, a designer and supplier of chipsets for mobile phones, included a clause in its licensing agreements with the manufacturers stipulating that it could freely use their patents.

Six major global cellphone makers, including NEC and Nokia Corp. (NYSE:NOK) , filed complaints against Qualcomm in 2005 over what they deemed were unfavorable terms in licensing agreements for patents related to wireless communications technologies needed to develop third-generation mobile phones.
