Absolutely true. The War Powers Act requires Congress to approve within 90 days; the intent is to allow "hot pursuit" and similar sorts of actions but not a unitary declaration of war, which is a power that belongs to Congress and not the Executive.
The problem with this sort of "sue sue sue" approach is that Congress can cut off the money immediately. So what this says is that "right now" Congress lacks the stones to actually enforce this through the process it has, and therefore you have Critters looking for "new ways" to accomplish the goal.
