Nov. 8--Three scientists say federal nuclear regulators owe Utahns an apology -- and a policy change -- for allowing shallow burial of depleted uranium, including the 49,000 tons already at EnergySolutions Inc.'s landfill in Tooele County.
The uranium enrichment waste gets increasingly hazardous for a million years, and that's too long to reasonably ensure the safety of any shallow landfills, especially one like the Tooele County site that is underwater a few hundred of every several thousand years.
Those wet cycles could spread long-lived radioactive material throughout the Great Salt Lake basin, the scientists say.

Nov. 7--A group created to protest American Ecology's plan to bring extremely low-level nuclear waste to its Owyhee County burial facility has closed up shop after the company filed a defamation lawsuit.
Rexburg-based Citizens for a Clean Idaho has taken its Web site down and failed to respond to a Nuclear Regulatory Commission staff report that discounted its claims about Westinghouse Electric's request for a federal exemption to ship 50,000 tons of soil and debris contaminated with extremely low levels of radioactive material to American Ecology's state-regulated facility.
The Idaho company filed a lawsuit in 4th District Court last week claiming the group and its founder Stephen Loosli -- with the support of American Ecology's Utah competitor EnergySolutions -- made false and misleading statements about American Ecology.

Nov. 4--WASHINGTON -- A House subcommittee swiftly advanced legislation Tuesday that would ban the importation of low-level radioactive waste from foreign countries, including halting a plan by Utah's EnergySolutions to bring Italian waste to U.S. soil.
The measure already is set to be heard Thursday by the full House Energy and Commerce Committee.
But even as the measure gains momentum in Congress, a Republican co-sponsor reversed course on the bill and introduced an amendment that would gut key language in favor of heightened scrutiny on importing foreign waste.

Nov. 3--WASHINGTON -- A House subcommittee swiftly advanced legislation Tuesday morning that would ban the importation of low-level radioactive waste from foreign countries, halting a plan by Utah's EnergySolutions to bring Italian waste to U.S. soil.
But even as the measure gains momentum in Congress, a Republican co-sponsor reversed course on the bill and introduced an amendment that would gut key language in favor of heightened scrutiny on importing foreign waste.
Rep. Ed Whitfield, R-Ky., said in a statement filed after a recent hearing on the bill that he initially signed on to it because of concerns about capacity for domestically produced radioactive waste, but any fears about that have been now been alleviated.

OPINION: Munger: Day of Remembrance to Honor Nuclear Workers

Oct. 28--The first National Day of Remembrance honoring workers in the nation's nuclear weapons program, many of whom fell sick and ultimately died as a result of workplace exposures, will be Friday, and Oak Ridge will be among the sites holding ceremonies.
Hundreds of thousands of workers have participated in the U.S. weapons program since its inception in World War II, when work began on the first atomic bombs.
The Department of Energy and the National Nuclear Security Administration are hosting Friday's event, which begins at 4 p.m. at the American Museum of Science and Energy.

Oct. 14--Utah's EnergySolutions Inc. is facing a new threat, one that goes beyond attempts to block it from burying foreign radioactive waste at its Tooele County disposal site.
A proposed shareholder class-action lawsuit, filed in the U.S. District Court for the Southern District of New York, is asking that EnergySolutions' initial public offering (IPO) of two years ago and a secondary offering the next year be rescinded.
The lawsuit contends the company and its officers and directors, in the offering prospectus, made false and misleading statements about EnergySolutions' financial condition, its business and future prospects, thereby inflating the price of the company's securities.

Bulky Waste Prompts EnergySolutions to Seek License Updates: Regulators Invite Public Views on Special Nuclear Material

Oct. 9--EnergySolutions Inc. wants to bring in large pipes and other discards from the cleanup of an old Manhattan Project site that are contaminated with Special Nuclear Material.
The U.S. Nuclear Regulatory Commission has issued a formal "finding of no significant impact" for the proposal and are seeking public comment on the project through Nov. 6.
The regulators say not only is the project in line with the company's existing state and federal permits, but it also could reduce the risk of accidents and injuries by allowing fewer cross-country trips of the radiation-tainted waste.

Hearing set on foreign nuke waste ban bill

SALT LAKE CITY - An effort to ban the importation of foreign nuclear waste has been given new life with a hearing set for next week in Washington, D.C.
The hearing for the Radioactive Import Deterrence Act was scheduled for Oct. 16.
Jim Matheson, D-Utah, and Bart Gordon, D-Tenn., drew it up in response to EnergySolutions Inc.'s plan to import up to 20,000 tons of low-level radioactive waste from Italy through the ports of Charleston, S.C., or New Orleans.

Investors Find It Pays to Stay Home: Utah Firms Showing Solid Results in First Nine Months.

Oct. 1--It has been a tumultuous year for Utah investors, but those who stuck close to home and purchased shares of companies with headquarters in the state in many instances were well rewarded for their efforts.
The Salt Lake Tribune /Bloomberg Index, which measures the share-price performance of the 27 leading publicly held companies based in Utah, was up more than 17 percent in the first nine months of 2009.
"Clearly the technology sector has been leading the way so far this year with [the tech heavy] Nasdaq up 44 percent," said Sterling Jenson, senior managing director of Wells Fargo Capital Management in Salt Lake City.

Revenues for the third quarter of 2009 were $364.9 million, compared with $419.5 million in the third quarter of 2008.
Net income attributable to EnergySolutions for the third quarter of 2009 was $12.9 million, or $0.15 per share, compared with $10.9 million, or $0.12 per share, for the third quarter of 2008.

Kendall Law Group, led by a former federal judge, today announced that a lawsuit has been filed against EnergySolutions, Inc. (NYSE: ES) for securities violations related to the company's initial public offering on November 14, 2007 and the Company's offering of securities on July 24, 2008, affecting stock purchased between November 14, 2007 and October 14, 2008.
The complaint, filed in the Southern District of New York, charges EnergySolutions, certain of its officers and directors, ENV Holdings, LLC and the main underwriters for the Offering with violations of the federal securities laws.
The statements in their offering documents for the Offerings about the opportunities in the nuclear industry were misleading in that they were not well situated in the near term to benefit from those opportunities.
