Normally I’d say woe to the CEO who crosses notoriously active investor Carl Icahn, but this time he might have met his match. Yes, other executives may have fallen to his ummm… persistent nature, but biotech Amylin Pharmaceuticals Inc. (Nasdaq: AMLN) lead independent director James Wilson, is having none of it. Along with strong shareholder Eastbourne Capital Management, Icahn has repeatedly attempted to stir up trouble at the company with the intent of changing the board of directors more to his liking. Back in early October I wrote in (Oct 1: Nowhere to Run, Nowhere to Hide) how there simply was no asset class (ex US Treasuries and US Dollar), no sector, no country to hide in. Everything stunk, and in fact it got worse in the ensuing weeks. September, October, November 2008 might be the worst 3 months ever (I don't have the date) but if not, it has to be in the top 3. We used to run a weekly screen here to identify areas of relative strength - it's been useless for months on end. But for curiousity sake I ran it to see the best performers over the past quarter. Eli Lilly & Co. (LLY) is entering a challenging period, brought about by recent pipeline disappointments, most notably uncertainty surrounding antiplatelet drug, Prasugrel. Although we believe the underlying fundamentals of the company remain solid, the recent pipeline setbacks and the high price of the ImClone (IMCL) acquisition will likely limit the upside to the stock. We also believe that sales of Zyprexa will begin to decline later in 2008 as generic Risperdal eats into market share. We see little movement in the stock due to these issues. For 2008 Lilly expects to grow EPS to $3.97 to $4.02 or 11.8% to 13.2% over 2007. After a 777 loss last Mon, Dow pulled another Mon sell-off only not quite as bad, down 370 taking it below 10K. Dow closed 400 points above the midday low of 9525 (but pulled back 100 from the peak about ½ hour prior to the close) as did other markets from an OVERSOLD position. However, problems remain. There were only 250 advancers on NYSE & NAZ dropped 83, again above midday lows. The S&P 500 fell to 1047, bringing it close the the magical 1000 line. This comes from all the confusion in the credit markets. Key stories are printed below. One would be a lot to digest. Eli Lilly Increases Earnings 21 Percent in Second Quarter

Jul. 22--Indianapolis drug maker Eli Lilly and Co. saw across-the-board gains in revenue and net income during its fiscal second quarter and raised its per-share guidance for 2009.
Lilly, the fifth-largest biotech company in the U.S., based on sales, with such products as Humalog and Byetta for diabetes, Forteo for osteoporosis and Xigris for sepsis, reported net income of $1.15 billion, a 21 percent jump from the $958 million earned in the same period in 2008.
"Lilly continues to deliver solid financial results notwithstanding the challenging global economic environment," said John Lechleiter, Lilly's chairman and chief executive officer, in a statement accompanying the company's earnings report.
