      <title>Notable Bankruptcies Of 2009: Q2</title>

      <description><![CDATA[In January I predicted (see Notable Bankruptcies of 2009: Q1) that “major” bankruptcies in 2009 would challenge the 383 mark set in 2001 (the high-water mark after the dotcom bubble). I even suggested that it was possible that we could exceed 400 “major” bankruptcies in 2009.    According to Bankruptcydata.com, there have been 156 “major” filings thus far in 2009. Assuming that bankruptcies are equally distributed throughout the year, this puts us on pace for 312 bankruptcies. That is tracking well shy of my prediction. In fact, bankruptcies were down significantly from Q1 to Q2, as there were 90 bankruptcies in the first quarter but only 66 in the second. In that circumstance, the creditor really doesn’t care whether or not the company goes under.” -Henry Hu  Basis traders have been successfully arbitraging bonds and credit defaults swaps. The downside is that the ideal outcome for a basis trader is actual bankruptcy. This is pitting shareholders, bondholders... errr... EVERY OTHER STAKEHOLDER against these basis traders. Interestingly enough, it seems the basis traders have the upper hand in the battle because they can sit and wait, while the other stakeholders cannot.  Talk about epic battle to the death.  General Electric (GE) for example is clearly caught in the crosshairs of this trade and is just one of many wounded enterprises currently being sniped... To me, it’s a scary list because many of the companies are not obscure, “never heard of them” names, but commonplace businesses, some of which have national reach.    For example, I’ve visited a Six Flags (SIX) theme park almost every year growing up.&#160; It’s stock now trades at $0.33 and made the list.    Rite-Aid (RAD) Pharmacies seem to be in most cities, but the economy has taken their share price down to $0.30 as well. Six flags reported a loss after preferred dividends of $132.4 million, or $1.39 per share, compared with a loss of $195.2 million, or $2.07 per share, a year earlier. This would lead folks to think things are getting better. While the reported loss improved over last year, if we look strip out the loss from discontinued operations in 2006, we find the loss from continuing operations in 2007 actually increased to $130.8 million, or $1.43 per share, compared with a loss of $100.5 million, or $1.12 per share a year earlier.
