Friedman Billings Ramsey comments on Tessera (NASDAQ:TSRA) after the Administrative Law Judge (ALJ) in the wireless ITC case determined that TSRA's asserted patents are valid but not infringed by the respondents (ATI, Freescale, Motorola, Qualcom, Spansion, ST Micro). FBR notes this is the same judge who (in February 2008) granted the same respondents a stay of motion, which was actually overruled by the ITC Commission 29 days later upon appeal by TSRA. (TSRA) licenses its proprietary advanced integrated chip (IC) packaging technology to semiconductor manufacturers, assemblers and material suppliers. The company does not produce any semiconductors but rather licenses the use of proprietary Intellectual Property (IP) associated with their packaging technology. Is Qualcomm The Best Semiconductor Company In The World?

IC Insights recently released their research bulletin that ranks the major semiconductor companies worldwide over the first three calendar quarters of 2008. The company provides two rankings in their free offering: a list of the top 20 by sales and a list of the top 20 by sales growth rate. Qualcomm (QCOM) is a notable performer on both lists: Qualcomm used a 27% year-over-year growth rate to jump five spots and rank as the 9th largest semiconductor supplier through the first three quarters of 2008.This 27% year-over-year growth rate is good enough to place Qualcomm in the number one position in the rankings based on sales growth.Ironically, Broadcom (BRCM), Qualcomm's rival both in the courtroom and in the cell phone industry, is close on Qualcomm's heels with a 26% growth rate that is good enough for the second spot in the growth rankings. Only two days after the Dow smashed the record for the largest one day gains in history, it once again continues its downward spiral and recorded the second largest loss in history with a 733 point drop at the closing bell today. The Nasdaq plummeted 8.47%, while the S&P experienced the greatest percentage reduction of the day by dropping 9.03%. The September retail sales report was released today and helped drive this bearish market further into the ground.September’s retail report gave investor’s a reality check that this recessionary period is still upon us. The retail industry accounts for two thirds of our nation’s GDP. Anytime bad news surfaces about this topic investors react to take this news into consideration. The estimated retail consensus was that consumers spent 0.6% less in September than they did in August. Forest Laboratories, Inc. (FRX) focuses on the therapeutic areas of the central nervous, cardiovascular and respiratory systems, as well as research and development programs that address a range of health conditions. Principal brands include Lexapro for depression, Namenda for Alzheimer's disease, and Benicar for high blood pressure. The company turned in a very strong FY 2008, but we are concerned about longer-term growth, especially towards the beginning of the next decade when Lexapro and Namenda are exposed to generic competition. That puts a lot of pressure on the pipeline to come through. Tessera Wins Key Patent Ruling

May 20--San Jose-based Tessera Technologies said Wednesday that the U.S. International Trade Commission has upheld its claim that several other companies had infringed its patented semiconductor-packaging technology.
The companies found to have infringed that technology are Motorola, Qualcomm, Spansion, ATI Technologies (a part of Advanced Micro Devices), Freescale Semiconductor and STMicroelectronics.
In issuing its ruling, the commission overturned a decision in December by one of its judges, who had concluded Tessera's patents had not been violated.
